Are Irrevocable Trusts Really Irrevocable

Presented by Al W. King, III, JD, LL.M., AEP, TEP

The answer to this question has never been more important as a result of powerful population trends, an uncertain economic, political and tax future, changing family situations, a desire to promote family values as well as a litigious society etc... This session will discuss the most important ways irrevocable trusts can be modernized such as judicial and non-judicial reformations and modifications, restatements, and decanting. Pre-mortem validations, other key statutes, cases, rulings as well as important dos and don’ts will be discussed. Trust reformations and modifications have become one of the most important estate planning tools providing families with the flexibility they desire and need.
